FinishLine Technologies Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FinishLine platform, including our website, mobile applications, and related services (collectively, the “Services”). By creating an account or using the Services, you agree to be bound by these Terms.

If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

1. Use of the Services

1.1 Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Services.

1.2 Account Registration

You are responsible for:

  • Providing accurate account information
  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account

We may suspend or terminate accounts that violate these Terms.

1.3 Acceptable Use

You agree not to:

  • Use the Services for unlawful or fraudulent purposes
  • Upload malicious code or attempt to disrupt the platform
  • Access or attempt to access accounts or data you are not authorized to view
  • Reverse engineer, decompile, or copy the Services

We reserve the right to investigate and take action against misuse.

2. User Content

2.1 Ownership

You retain ownership of all documents, data, and materials you upload (“User Content”). By submitting User Content, you grant FinishLine a limited license to store, process, and display it as necessary to provide the Services.

2.2 Responsibility

You are solely responsible for:

  • The accuracy and legality of User Content
  • Ensuring you have rights to upload the materials
  • Managing permissions for your project participants

FinishLine is not responsible for disputes between project collaborators.

3. Service Features and Availability

3.1 Modifications

We may update or modify the Services at any time to improve functionality, security, or performance. We will make reasonable efforts to notify users of significant changes.

3.2 Availability

We strive to maintain reliable uptime but do not guarantee uninterrupted access. Planned maintenance or unforeseen outages may occur.

4. Payment and Subscriptions

4.1 Billing

Some features require a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.2 Renewals

Subscriptions automatically renew unless canceled before the renewal date.

4.3 Refunds

Payments are generally non-refundable unless required by law or explicitly stated otherwise.

5. Confidentiality and Data Protection

We will handle your information in accordance with our Privacy Statement. You agree not to disclose confidential information obtained through the Services except as permitted by law or with written consent.

6. Third-Party Services

The Services may integrate with third-party platforms (e.g., Procore, Autodesk, cloud storage providers). Your use of those services is governed by their respective terms. FinishLine is not responsible for third-party systems or data handling practices.

7. Intellectual Property

All intellectual property related to the Services - including software, branding, logos, and design - is owned by FinishLine or its licensors. You may not copy, modify, or distribute any part of the Services without written permission.

8. Termination

We may suspend or terminate your access to the Services if:

  • You violate these Terms
  • You fail to pay subscription fees
  • We discontinue the Services

You may terminate your account at any time by contacting support.

Upon termination, we may retain User Content as required for legal or contractual obligations.

9. Disclaimers

The Services are provided “as is” without warranties of any kind, including:

  • Fitness for a particular purpose
  • Availability or error-free operation
  • Accuracy of data or outputs

You use the Services at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, FinishLine is not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Issues caused by third-party integrations or user actions

Our total liability will not exceed the amount paid for the Services in the preceding 12 months.

11. Governing Law

These Terms are governed by the laws of the state or jurisdiction where FinishLine is headquartered, without regard to conflict-of-law principles.

12. Changes to These Terms

We may update these Terms periodically. When changes are made, we will revise the “Effective Date” above. Continued use of the Services constitutes acceptance of the updated Terms.
